מדיניות ביטולים – אנא ראו סעיף 6

כללי
1.1 פאניקה חדרי בריחה מספקת מגוון שירותים בינם שירותי בידור, בין היתר, באמצעות משחקים אינטראקטיביים המבוססים על שימוש ביכולות לוגיות ועבודת צוות של משתתפיה (להלן:

"המשחקים" ו/או "המוצר". הזמנת המשחקים (להלן: "ההזמנה" ו/או "הזמנת המשחק") מתבצעת הן באמצעות מכירה באתר החברה panica-escape.co.il (להלן: "האתר") והן באמצעות מכירה במשרדי החברה. מזמין המשחק ו/או מי מטעמו ו/או מי שבא לממש את ההזמנה בתאריך ושעת תחילת המשחק בהתאם להזמנה (להלן: "המועד הקבוע" ו/או "תחילת המשחק") הינו לקוח של החברה (להלן: "הלקוח" ו/או "המזמין").

1.2 תקנון זה מנוסח בלשון זכר חרף היותו פונה לכל המינים, וזאת מטעמי נוחות ומגבלות השפה העברית.

1.3 השימוש באתר ו/או הרישום באתר ו/או הזמנת המשחקים והתשלום עבורם מהווים את הסכמת הלקוח לקבל את התקנון ולנהוג לפיו. לפיכך, אם הלקוח איננו מסכים לתנאי מתנאיו הוא מתבקש שלא לעשות כל שימוש באתר ו/או לעבור רישום באתר.

1.4 הוראות תקנון דנן יחולו על כל שימוש שיעשה על-ידי הלקוח. המשך השימוש באתר על-ידי הלקוח מהווה הסכמה להוראות התקנון היוצרת התקשרות מחייבת בין הלקוח לחברה.

הליך רכישה
2.1 להזמנת המשחק באמצעות האתר יש לבחור את המשחק ואת השעה הפנויה הרצויה (להלן: "בחירת המשחק") ולעבור רישום לאתר.

2.2 רישום לאתר מבוצע על-ידי מילוי פרטים כגון שם ושם משפחה, שם קבוצה, דואר אלקטרוני ומספר הטלפון הנייד (להלן: "פרטי הזמנה").

2.3 לאחר הרישום, יישלח ללקוח באמצעות דואר אלקטרוני אישור להזמנה. אישור הזמנת המשחק יחייב את החברה רק לאחר תשלום דמי מקדמה או תשלום מלא עבור המשחק. תשלום זה יגבה טלפונית. במקרה של משלוח, לאחר תשלום מלא ומאושר ההזמנה תחייב את החברה ותתואם מסירה.

2.4 מתן פרטים כוזבים מהווה עבירה פלילית, והעושה כן צפוי להליכים משפטיים פליליים ואזרחיים.

2.5 ביטול הזמנה יתבצע בכפוף לסעיף 6 להלן. או לחילופין על בסיס סירוב לשלם דמי מקדמה אשר יגבו מראש טלפונית ע"פ שיקול דעת פאניקה בלבד.

2.6 הזמנות מזדמנות ו/או הזמנות למועד הקצר מיממה מרגע ההזמנה ועד למועד המשחק תחייבנה את הלקוח לבצע וידוא טלפוני אל מול פאניקה בדבר יכולתה לערוך / לספק את המשחק במסגרת הזמן הקצובה. באם לאו, לא יגבו דמי ביטול עבור המשחק. במקרה זה תתבצע גבייה של 100% משווי ההזמנה.

שירות לקוחות
3.1 בשאלות לגבי האתר, פעילותו והמוצרים המוצגים באתר ניתן לפנות לשירות הלקוחות בדואר אלקטרוני: hello@panica-escape.co.il ו/או בטלפון 03-7754644.
שירות הלקוחות יעשה את מירב המאמצים להתייחס לכל פנייה בתוך 2 יממות (48 שעות) ממועד הפניה.

כשירות להשתמש באתר
4.1 הלקוח רשאי לבצע הזמנה למשחק בכפוף למילוי התנאים המצטברים המפורטים להלן:

4.1.1 הלקוח כשיר לבצע פעולות משפטיות מחייבות.

4.1.2 הלקוח בעל תעודת זהות ישראלית או דרכון זר תקפים או תאגיד המאוגד והרשום כדין במשרד הפנים בישראל או במשרד פנים במדינה זרה.

4.1.3 הלקוח בעל כתובת דואר אלקטרוני ברשת האינטרנט.

4.2. מבלי לגרוע מן האמור לעיל, החברה רשאית למנוע מהלקוח לבצע הזמנה באתר אם מתקיים אחד או יותר מן תתי הסעיפים להלן:

4.2.1 הלקוח ביצע או ניסה לבצע מעשה בלתי חוקי ו/או עבר על הוראות הדין תוך כדי שימוש באתר או השתתפותו במשחק.

4.2.2 הלקוח הפר תנאי מתנאי התקנון.

4.2.3 הלקוח מסר בעת ההרשמה פרטים כוזבים.

4.2.4 הלקוח ו/או מי מטעמו ביצע ו/או ניסה לבצע מעשה או מחדל שיש בו כדי לפגוע באתר ו/או בפעילותו התקינה של האתר ו/או החברה ו/או כדי לפגוע בצד שלישי תוך כדי שימוש באתר.

סודיות מידע
5.1 החברה לא תעשה כל שימוש במידע הנמסר ללא הרשאת הלקוח אלא אם כן הדבר נדרש על-פי דין או כדי למנוע שימוש לרעה. החברה תאפשר גישה למידע רק לאלה מעובדיה הזקוקים למידע לצורך מתן שירות.

5.2 החברה נוקטת באמצעי זהירות מקובלים על מנת לשמור, ככל האפשר, על סודיות המידע, אך בקרות מקרים שאינם בשליטתה ו/או שנובעים מכוח עליון, החברה לא תהיה אחראית לכל נזק מכל סוג שהוא, עקיף או ישיר, שייגרם ללקוח ו/או למי מטעמו אם מידע זה יאבד או אם יעשה בו שימוש לא מורשה. למען הסר ספק, החברה לא תהיה אחראית לכל חשיפת המידע כתוצאה מפריצה של גורמים לא מורשים לאתר.

ביטול הזמנה ומדיניות החזרים
6.1 לקוח רשאי לבטל את ההזמנה.

6.2 ביטול הזמנה יבוצע דרך התקשרות טלפונית עם שירות לקוחות של החברה (ראה בסעיף 3.1 לעיל) או דרך מנגנון הביטול באתר החברה.

6.3 בביטול הזמנה עד 48 שעות לפני תחילת המשחק – הלקוח לא יחויב בדמי ביטול. במקרה והלקוח ביטל את ההזמנה פחות מ-48 שעות ועד 6 שעות לפני תחילת המשחק, כאמור בסעיף 2.5 לעיל, ייגבו דמי ביטול בגובה של 50% מעלות ההזמנה. במקרה והלקוח ביטל את ההזמנה פחות מ-6 שעות לפני תחילת המשחק – יחויב הלקוח בדמי ביטול מלאים המהווים 100% מסכום ההזמנה ולא יהיה זכאי להחזר כספי כלשהו. אם הלקוח לא הגיע כלל למשחק או איחר במעל מ- 20 דקות (עשרים דקות) למועד הקבוע למשחק ,זכאותו לשחק במשחק במועד הקבוע תישלל לאלתר והלקוח יחויב בדמי ביטול מלאים המהווים 100% מסכום ההזמנה ולא יהיה זכאי להחזר כספי כלשהו.

6.4 במקרה והתשלום עבור הזמנת המשחק בוצע באמצעות קופון מתנה והמשחק בוטל על-ידי הלקוח פחות מ- 96 שעות לפני תחילת המשחק, לא יוחזר כסף ללקוח עבור קופון המתנה. במקרה והלקוח לא הגיע כלל למשחק או איחר במעל מ- 20 דקות למועד הקבוע למשחק, תישלל זכאותו למשחק נוסף.

6.5 הלקוח לא יהיה זכאי לקבל החזר כספי או משחק חלופי עבור משתתפים שלא הגיעו כלל או איחרו למשחק במועד הקבוע (לדוגמה: הזמנה בוצעה עבור ארבעה משתתפים, אך בפועל במועד הקבוע הגיעו רק שניים מתוך ארבעת המשתתפים).

6.6 האתר רשאי לבטל הזמנה, כולה או חלקה במקרים להלן:

6.6.1 אם נפלה בהזמנה טעות כלשהי.

6.6.2 במקרה ויתברר כי ההזמנה לוותה בפעילות בלתי חוקית של הלקוח ו/או צד שלישי כלשהו.

6.6.3 כאשר העסקה בוצעה שלא כדין ושלא על פי תקנון זה.

6.6.4 עקב תקלה טכנית, מחלת איש/אנשי צוות או נסיבות שאינן בשליטת החברה.

6.7 אודות ביטול ההזמנה תימסר ללקוח הודעה בטלפון ו/או בכתב לכתובת הדואר האלקטרוני אותה ציין בעת בצוע ההזמנה.

תנאים נוספים
7.1 נפלה טעות בתיאור המוצר, לא יחייב הדבר את החברה.

7.2 טעות בכדאיות העסקה מצד הלקוח לא תזכה את הלקוח בביטול העסקה והחברה תהיה זכאית לגבות את מלוא הסכום עבור ההזמנה.

7.3 החברה ו/או מי מטעמה לא יהיו אחראים ולא יישאו בכל נזק ישיר או עקיף, תוצאתי או מיוחד, שנגרם ללקוח או לצד שלישי כתוצאה משימוש או רכישה שלא על-פי תקנון זה, תהא עילת התביעה אשר תהא, לרבות הפסד הכנסה ו/או מניעת רווח שיגרמו מכל סיבה שהיא. האתר שומר את הזכות לבטל את הרכישה הספציפית בהודעה בכתב למבצע הפעולה.

7.4 אחריות החברה בגין כל נזק שהוא מוגבלת לגובה הסכום ששולם לה על-ידי הלקוח בגין הזמנתו.

7.5 כל רישומי המחשב של האתר בדבר הפעולות המתבצעות דרך האתר יהוו ראיה לכאורה לנכונות הפעולות של כל הצדדים.

7.6 כל מידע ו/או תצוגה המופיעים באתר, לרבות גרפיקה, עיצוב, הצגה מילולית, סימני מסחר, סימני לוגו וכן עריכתם והצגתם של אלה, הינם בבעלות הבלעדית של החברה ו/או מי מטעמה. אין להעתיק ,לשכפל, להפיץ, לפרסם או להשתמש בכל דרך אחרת בתכנים המופיעים באתר אלא בהסכמת החברה בכתב ומראש. כל המוצרים המופיעים באתר זה כפופים לזכויות יוצרים על-פי החוק.

7.7 החברה תהיה רשאית להשתמש בתמונות ו/או כל חומר אחר (להלן:" חומרים דיגיטאליים") בהם מופיעים המשתתפים. החברה תהיה רשאית להפיק חומרים דיגיטאליים לפני ו/או במהלך ו/או אחרי המשחק לכל מטרה, על פי שיקול דעתה הבלעדי ובכל עת, כל אלו בכפוף ובהתאם להוראות הדין .

7.8 המשתתפים מתחייבים להימנע משתיית אלכוהול ו/או משימוש בסמים טרם הגעתם למיקום המשחק ו/או במהלכו, מפקחי המשחק יהיו רשאים לא לאפשר השתתפותם של המשתתפים במשחק וכמו כן, לא יתאפשר זיכוי כספי עבורם.

7.9 פרשנותו ואכיפתו של תקנון זה ו/או כל הנובע ממנו יעשו בהתאם לחוקי מדינת ישראל, ויתבררו במידת הצורך, בבית המשפט המוסמך בתל אביב-יפו בלבד.

תקנות הנוגעות לחדר "חופשי על הבר"
8.1 הפעילות בחדר מלווה בהכנה של משקאות. כל משקה אשר יוכן על ידי המשתתפים במהלך הפעילות בחדר יינתן לו כשי עם סיום הפעילות.

8.2 היות וקיימת האפשרות בידי המשתתפים להוסיף אלכוהול למשקה אותו הם מכינים, הכניסה לחדר מותנית בהצגת תעודה מזהה ובבדיקת גילו של המשתתף.

8.3 מקום שבו משתתף הינו קטין, לא תינתן בידו האפשרות להוסיף אלכוהול למשקה המוכן במהלך הפעילות בחדר.

8.4 מקום שבו הפעילות צפויה להסתיים לאחר השעה 23:00 (ועד לשעה 06:00 למחרת), לא תתאפשר כניסה של קטינים.

8.5 מובהר כי במהלך הפעילות כל משתתף מכין משקה אחד בלבד, וכל משתתף יקבל כשי לכל היותר משקה אחד בלבד.

8.6 לאור אופיה של הפעילות הבעלים או המפעיל שומר לעצמו את הזכות לסרב ולהכניס לפעילות כל משתתף, לפי שיקול דעתו המוחלט. עוד שומר לעצמו הבעלים או המפעיל את הזכות להימנע ממתן האפשרות להוספת אלכוהול למשקאות אותם מכינים המשתתפים, על פי שיקול דעתו המוחלט.

The company holds the right to amend or vary the terms and conditions below including any of the contents of this website from time to time at its sole discretion without prior notice.
The terms and conditions apply to the use of the website by any visitor and should be read carefully before any use.
The company does its best to supply you with the most up to date and accurate information on the website.
The website is for your personal and non-commercial use. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer or sell any information obtained from this website without the written consent of the company.
You are not permitted to link to, or use all, or any part of the the website for any purpose which is fraudulent, unlawful, defamatory, harmful, obscene or objectionable.
You accept that the Internet is not fully secure. The company will take all appropriate steps to protect your information.
The company shall not be liable to any person for any direct or indirect, consequential or incidental damages, including (without limitation) lost profits or revenues, loss of opportunity, costs of replacement goods or services, loss or damage to data or business interruption, arising out of any use of the website.
By booking your experience and making a purchase, you and all players in your team agree to be bound by the following Terms and Conditions. Please make sure that all players in the team have read and understood all the Terms and Conditions before proceeding to booking your experience.
Nothing in these Terms and Conditions are intended to affect your statutory rights.
We hold the right to amend or vary these Terms and Conditions including any of the contents of this website from time to time without prior notice.
All of these terms and conditions are governed by Israeli Law and any disputes or claims will be dealt with by the Courts of Israel.
This website collects and stores your personal details that you provide. We will take all appropriate steps to protect your information and will not disclose it to any third party.
You must not use our website in any way that causes, or may cause, damage, impairment of the availability or accessibility, or in any way in connection with, any unlawful, illegal, fraudulent or harmful purpose or activity.
This website may contain hyperlinks to third party websites and the operation of those websites is out of our control. You may use them at your own risk and we accept no liability for any damage arising out of the use of those websites.
We shall not be liable to any person for any direct or indirect, consequential or incidental damages, including (without limitation) lost profits or revenues, loss of opportunity, costs of replacement to goods or services, loss or damage to data or business interruption, arising out of the use of our website.

2. GENERAL

Nothing in these terms and conditions is intended to affect your statutory rights.
The game is designed for a team of 2-8 persons per game. Minimum participants per event is 2 persons.
The trademarks and logos of the company displayed on the website are the property of the company. You are not permitted to use these without a written consent of the company and you accept that any such use may constitute an infringement of the relevant proprietor’s rights.
These terms and conditions and any contract concluded incorporating these terms and conditions shall be governed by Israeli law and all disputes shall be submitted to the exclusive jurisdiction of the Israeli courts.
The company collects and stores your personal details without disclosing it to any 3rd party and is dedicated to ensure that the privacy of your personal information is protected.
For safety and security purposes, the company reserves the right to record games and keep the recordings.
The company may contact you from time to time with offers and promotions via email or phone.
The company is entitled to charge the guests for any damage which is intentional and/or caused by misuse of items.
While your are on our premises, you must ensure to conform to our codes and regulations, adopt proper standards of behaviour, and cooperate with our employees.
The company does not tolerate any forms of harassment, anti social behaviour or abuse (verbal or physical), towards its staff and/or customers. Any instances of the above will result in the immediate termination of your game and possible prosecution without refund.

3. BOOKINGS

The price of a game is stated on the website under the booking section.
The price is set according to number of people within the same booking and to the timing of the week.
This is a live event game, and once the booking is confirmed, we can not accept any cancellations or give any refunds.
Any purchase on the website is only valid when processed by the company. You shall receive a confirmation once your booking is processed.
If you wish to transfer your booking(s) into someone else’s name, you must contact the company by either email or telephone at least 72 hours prior to the start of your booking.
Bookings may not be transferred or resold for commercial purposes or at a premium. If a booking is transferred or resold in breach of this condition, the bearer of the booking or the person claiming the right to attend the event will be refused admission.
You are entirely responsible for entering your details correctly on the online booking form.
A booking becomes a no-show and entry will be declined if the team is late 15 minutes or more. In such a situation the money is not refundable and the booking is not changeable.
If you are late for more than 15 minutes of the original starting time of your booking, the reservation becomes a no-show automatically and you will be refused entry.
Our prices and promotions shown on this website are subject to change without notice.
By booking your experience and making a purchase on this website you agree that you have permission from the cardholder.
Each team in the booking must have at least 1 adult that is aged 16 or above. It is the responsibility of the adults (above 16) of the team to look after any team players that are aged below 16.
If there are any players who have mobility or accessibility issues, please make their visit known to us at the time of booking. This will assure that we can make every effort for those concerned to also enjoy their experience without worry.
Your booking is only confirmed once we have received full payment and we have sent you a booking confirmation email.
Upon receipt of our booking confirmation email, if you believe that any information is incorrect you must advise us immediately as changes to your booking in the future may not be possible.
Bookings cannot be resold for commercial gain or profit by anyone other than the company or our authorised sub-agents. Any booking that is discovered to have breached this condition will be voided without refund and the holder may be refused entry to, or ejected from the venue.
Should you wish to transfer your booking to someone else, you must contact us in reasonable time ahead of your booking with your request.
We reserve the right to cancel bookings which we reasonably suspect to have been made fraudulently. If this is the case you will be notified by email or phone and no refund will be offered.
We may contact you with offers and promotions via your email address that you’ve provided for your booking. You can be removed from our mailing list at any time by contacting us at hello@panica-escape.co.il

4. CANCELLATION AND RESCHEDULING

Should you need to cancel or reschedule your booking for any reason, please contact us with your request at hello@panica-escape.co.il . Our policies are as follows:
There will be no refunds offered for cancellations.
You may reschedule the booking if you give us more than 7 days notice. There are no fees for rescheduling.
If your booking is within 7 days from the time you book, or you give us less than 7 days notice from a future booking, you cannot cancel or reschedule.
Should we need to cancel or reschedule your booking for any reason, we will use reasonable endeavours to notify you of this change. In this instance we will offer a 100% refund without a cancellation fee or offer an alternative date for your booking.
Although we will use our best efforts, we cannot guarantee that we will be able to reach you to inform you of such change. Therefore it is your responsibility to ascertain whether your booking has been cancelled or rescheduled. For your peace of mind, we will advertise any changes to any bookings on our home page of our website with reasonable notice.

5. UPON ARRIVAL

To enter our venue you must confirm the full name of the person who made the booking. You may also be asked to confirm other contact details should we need it.
Although no physical strength should be needed for the experience, it is your responsibility to ensure you are fit to participate. You should not participate in any physical challenges if you are pregnant, prone to seizures, or have heart or respiratory problems.
We will reserve the right to refuse entry to our venue if you appear in any way to be unfit for the forthcoming experience, or under the influence of alcohol, drugs or other substances.
In case you have brought less players to the experience than booked, with a minimum of 2 players in a team, the price difference will not be refunded.
In case you have brought more players to the experience than booked, the price difference can be settled upon arrival.
It remains the responsibility of the person who made the booking to ensure that these additional players agree to these Terms and Conditions and are in receipt of all relevant information relating to the booking.
Please arrive up to 5 minutes early before your booking to ensure you get the most out of your experience. If you are late to your booking then the length of your experience may be cut short so that it won’t run into the next customer’s booking.

6. THE EXPERIENCE

You and all team players must listen and follow instructions from our Game Masters (operators) at all times. These instructions that are given by our Game Masters will include, but not limited to, the agenda of the experience, rules of the escape game, and health and safety instructions. If any of these instructions are not followed, we reserve the right to stop your experience and eject your team out of the venue without refund.
At no point are you to use force during the experience. The escape game has been designed to be robust and low risk to damage. If it appears that physical force is intentional then this will be considered a breach of our conditions and we will stop your experience. If you deliberately damage something, you will be liable to pay for damages and asked to leave. We will treat these circumstances on a case by case basis.
If you are found to be under the influence of alcohol or other substances during the experience, you will be ejected from the venue without refund.
CCTV images will be recorded throughout the experience and remain property of Panica.
Although with our best efforts in keeping your belongings secure at our venue, we will accept no responsibility for said belongings.
Our experience has been designed to be in a safe and secure environment, however we will accept no responsibility for any liability, harm, injury or death, cost or expense whatsoever that may arise directly or indirectly from attending an experience at Panica. You agree to accept liability for yourselves.
We reserve the right to stop the experience, without refund, to which in the opinion of our Game Masters, customers who behave in a manner is likely to affect the enjoyment of our other customers, or customers who use threatening, abusive words or behaviour to other customers or members of staff, or customers who do not follow written or verbal instructions, or behave in a manner that may risk the health and safety of themselves, other customers or members of staff. Where a customer is part of a group, we reserve the right to remove the whole group from the venue in addition to the individual involved, without refund.
Except where otherwise specified in our cancellation policy, we regret we cannot accept liability or pay any compensation where the performance of our contractual obligations is affected by reason of circumstances amounting to “Force Majeure”. Force Majeure means any event which we could not, even with all due care, foresee or avoid, including but not limited to, war or threat of war, riots, civil strife, terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, fire and similar events beyond our control.
